New York Legal Action Against Kalshi
The state of New York has taken legal action against prediction market platform, Kalshi, over allegations of illicit operations within the state. Kalshi, a platform that allows people to ‘bet’ on the outcomes of real-world events has been operating without an official gaming license. The platform has been a center of numerous controversies, including offering sports betting and event wagering services without legal authorizations.
Legal Petition by the State
The Attorney General for the state of New York, in collaboration with Governor Kathy Hochul, last week made public a legal petition against Kalshi. The petition asked the New York Supreme Court to declare Kalshi’s operations illegal and put a halt to the company’s activities related to betting and wagering on real-world events.
According to the petition, the state seeks an account balance of all customer engagements with the company’s platforms, including bets placed, losses incurred, and Kalshi’s gains from the bookmaking activities. The petition also goes further to ask for restitutions, damages, and civil penalties.
Punishment Sought by the State
In addition to halting the company’s operations and seeking a summary of its bookmaking activities, the state is also seeking severe financial penalties against Kalshi. Based on a statement released by Governor Kathy Hochul and Attorney General Letitia James, the state is looking to impose a penalty that is three times greater than Kalshi’s profits from its unlicensed activities.
Furthermore, the state is looking to impose a penalty of $100,000 for each instance where sports or mobile sports betting offers were made illegally. The extent of these penalties demonstrates the state’s commitment to crack down on non-compliant betting and wagering platforms.
Kalshi’s Operations and Valuation
Kalshi is a significant player within the prediction markets sector. During its most recent funding round in June, the company targeted a valuation of a lofty $40 billion. The legal difficulties in New York is not the first to be faced by Kalshi. The company and the prediction market sector at large are facing legal battles across the United States of America. In Minnesota, another battleground state, Kalshi and its competitor, Polymarket, secured a temporary victory when the U.S. District Court for the District of Minnesota ruled against a law banning prediction markets in the state.
The court determined that this state law likely contradicted the federal Commodity Exchange Act and granted a preliminary injunction against the law to both companies and the Commodity Futures Trading Commission. This ruling gave Kalshi and Polymarket permission to continue operations in the state, at least for now. Ultimately, these cases could set a precedent for change in the broadly unregulated terrain of prediction markets.
